The Housing Benefit (Habitual Residence) (Amendment) Regulations 2025

The Secretary of State makes these Regulations in exercise of the powers conferred by sections 123(1)(d), 137(2)(i) and 175(1) and (3) of the Social Security Contributions and Benefits Act 1992.The Social Security Advisory Committee has agreed that the proposals in respect of these Regulations should not be referred to it, in accordance with section 173(1)(b) of the Social Security Administration Act 1992.The Secretary of State has consulted with organisations appearing to the Secretary of State to be representative of the authorities concerned, in accordance with section 176(1)(a) of the Social Security Administration Act 1992.
Citation, commencement and extent

(1) These Regulations may be cited as the Housing Benefit (Habitual Residence) (Amendment) Regulations 2025 and come into force on 21st October 2025.
(2) These Regulations extend to England and Wales and Scotland.
Amendment of the Housing Benefit Regulations 2006

In regulation 10 of the Housing Benefit Regulations 2006 (persons from abroad), for paragraph (3B)(k) substitute—“
(k) in receipt of income support, an income-related employment and support allowance or universal credit;”.
