The Civil Enforcement of Parking Contraventions (County of East Sussex) (Amendment), Bus Lane Contraventions (Approved Local Authorities) (Amendment) and Moving Traffic Contraventions Designation Order 2025

The Secretary of State makes this Order in exercise of the powers conferred by paragraphs 8(1), 9(1) and 10(1) of Part 2 of Schedule 8 and paragraph 3(1) of Schedule 10 to the Traffic Management Act 2004(“the Act”).East Sussex County Council has applied to the Secretary of State for an order to be made in exercise of the powers in paragraph 8(1) of Part 2 of Schedule 8 and paragraph 3(1) of Schedule 10 to the Act in respect of parts of its area.Brighton and Hove City Council, the Borough Council of Calderdale, Cornwall Council, Dorset Council, Kirklees Borough Council, Knowsley Metropolitan Borough Council, Milton Keynes City Council and Slough Borough Council have each applied to the Secretary of State for an order to be made in exercise of the powers in paragraph 10(1) of Part 2 of Schedule 8 to the Act in respect of parts of their respective areas. Pursuant to paragraphs 8(3) and 10(4) of Part 2 of Schedule 8 and paragraph 3(4) of Schedule 10 to the Act, the Secretary of State has consulted the chief officers of the Sussex Police, West Yorkshire Police, Devon and Cornwall Police, Dorset Police, Merseyside Police and Thames Valley Police. 
Citation, commencement and extent

(1) This Order may be cited as the Civil Enforcement of Parking Contraventions (County of East Sussex) (Amendment), Bus Lane Contraventions (Approved Local Authorities) (Amendment) and Moving Traffic Contraventions Designation Order 2025 and comes into force on 9th December 2025.
(2)  This Order extends to England and Wales. 
Interpretation

In this Order “relevant date” means the date on which this Order is made. 
Amendment of the Road Traffic (Permitted Parking Area and Special Parking Area) (County of East Sussex) (Borough of Hastings) Order 1999

(1) The Road Traffic (Permitted Parking Area and Special Parking Area) (County of East Sussex) (Borough of Hastings) Order 1999 is amended as follows.
(2) In article 3 (application)— 
(a) omit “excluding that length of the A21 trunk road situated between the Hastings Borough boundary and the southern side of the junction with Junction Road”;
(b) insert “the whole of” before “the Borough of Hastings”.
Amendment of the Road Traffic (Permitted Parking Area and Special Parking Area) (County of East Sussex) (District of Lewes) Order 2004

(1) The Road Traffic (Permitted Parking Area and Special Parking Area) (County of East Sussex) (District of Lewes) Order 2004 is amended as follows. 
(2) In article 3 (application), omit the words from “except—” to the end of that article. 
Amendment of the Bus Lane Contraventions (Approved Local Authorities) (England) Order 2005

(1) The Bus Lane Contraventions (Approved Local Authorities) (England) Order 2005 is amended as follows.
(2) In the table in Schedule 2, after the row relating to the City of Bradford Metropolitan District Council, insert—
“Cambridgeshire County Council 2023/1256, 2025/788”.
Designation of civil enforcement areas for moving traffic contraventions

The Secretary of State designates each of the following areas as a civil enforcement area for moving traffic contraventions—
(a) the part of the area of Brighton and Hove City Council designated as a permitted parking area and as a special parking area by the Road Traffic (Permitted Parking Area and Special Parking Area) (City of Brighton and Hove) Order 2001 as it had effect immediately before the relevant date;
(b) the part of the area of the Borough Council of Calderdale designated as a permitted parking area and as a special parking area by the Road Traffic (Permitted Parking Area and Special Parking Area) (Metropolitan Borough of Calderdale) Order 2006 as it had effect immediately before the relevant date;
(c) the whole of the area of Cornwall Council designated as a civil enforcement area and as a special enforcement area by the Civil Enforcement of Parking Contraventions Designation Order 2010 as it had effect immediately before the relevant date;
(d) the parts of the area of Dorset Council— 
(i) designated as a permitted parking area and as a special parking area by the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Dorset) (Borough of Christchurch) Order 2003, the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Dorset) (Borough of Weymouth and Portland) Order 2002, the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Dorset) (District of North Dorset) Order 2002 and the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Dorset) (District of Purbeck) Order 2002 as they had effect immediately before the relevant date; and
(ii) designated as a civil enforcement area and as a special enforcement area by the Civil Enforcement of Parking Contraventions Designation Order 2016 as it had effect immediately before the relevant date;
(e) the part of the area of Kirklees Borough Council designated as a permitted parking area and as a special parking area by the Road Traffic (Permitted Parking Area and Special Parking Area) (Metropolitan Borough of Kirklees) Order 2006 as it had effect immediately before the relevant date; 
(f) the part of the area of Knowsley Metropolitan Borough Council designated as a civil enforcement area and as a special enforcement area by the Civil Enforcement of Parking Contraventions Designation Order 2014 as it had effect immediately before the relevant date;
(g) the part of the area of Milton Keynes City Council designated as a permitted parking area and as a special parking area by the Road Traffic (Permitted Parking Area and Special Parking Area) (Borough of Milton Keynes) Order 2002 as it had effect immediately before the relevant date;
(h) the part of the area of Slough Borough Council designated as a permitted parking area and as a special parking area by the Road Traffic (Permitted Parking Area and Special Parking Area) (Borough of Slough) Order 2003 as it had effect immediately before the relevant date.
