Retained Eu Law Reform
The Retained EU Law (Revocation and Reform) Act 2023 (Agricultural Products) (Consequential Amendment) (Scotland) Regulations 2025

The Scottish Ministers make the following Regulations in exercise of the power conferred by section 19(1) of the Retained EU Law (Revocation and Reform) Act 2023 and all other powers enabling them to do so.

There has been a public consultation as required by Article 9 of Regulation (EC) No 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety.
Citation and commencement
1 
These Regulations may be cited as the Retained EU Law (Revocation and Reform) Act 2023 (Agricultural Products) (Consequential Amendment) (Scotland) Regulations 2025 and come into force on 14 February 2026.
Council Regulation (EC) No 1234/2007

Council Regulation (EC) No 1234/2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) is amended as follows—
(a) in Article 114(2) (marketing standards for milk and milk products), for “retained EU” substitute “assimilated”,
(b) in Annex 15 (marketing standards applying to spreadable fats referred to in Article 115), in Point 2 (labelling and presentation), paragraph 3, for “retained EU” substitute “assimilated”.
The Eggs and Chicks (Scotland) (No. 2) Regulations 2008

The Eggs and Chicks (Scotland) (No. 2) Regulations 2008 are amended as follows—
(a) in schedule 1 (retained EU provisions relating to eggs for hatching and chicks contravention of which is an offence), in the schedule heading, for “RETAINED EU” substitute “ASSIMILATED”,
(b) in schedule 2 (retained EU provisions relating to eggs in shell for consumption contravention of which is an offence)—
(i) in the schedule heading, for “RETAINED EU” substitute “ASSIMILATED”,
(ii) in Part 2, in the Table, in the final row (Article 30(3)), in column 3, for “retained EU” substitute “assimilated”.
The Beef and Pig Carcase Classification (Scotland) Regulations 2010

The Beef and Pig Carcase Classification (Scotland) Regulations 2010 are amended as follows—
(a) in regulation 2(1) (interpretation), in each place where it occurs, for “retained EU” substitute “assimilated”,
(b) in regulation 5(3) (application of these Regulations to small-scale bovine operators), for “retained EU” substitute “assimilated”,
(c) in regulation 19 (offences: retained EU beef provisions)—

The Poultrymeat (Scotland) Regulations 2011

The Poultrymeat (Scotland) Regulations 2011 are amended as follows—

(c) in regulation 8 (enforcement), in each place where it occurs in paragraphs (1), (2) and (3), for “retained EU” substitute “assimilated”,
