The Firefighters’ Pension Schemes (Miscellaneous Amendments) (Wales) Regulations 2024

The Welsh Ministers make these Regulations in exercise of the powers conferred on them by sections 34(1), (2) and (4), and 60(2)(a) of the Fire and Rescue Services Act 2004, now vested in the Welsh Ministers, sections 1(1) and (2)(f), and 2(1) (together with paragraph 6(b) of Schedule 2) and section 3(1), (2) and (3)(a) and (b) of the Public Service Pensions Act 2013 (“the 2013 Act”) and sections 18(1), 19(1), (4) and (5), 21(1) to (3) and 22(1) and (6) of the Public Service Pensions and Judicial Offices Act 2022.
In accordance with section 3(5) of the 2013 Act, regulations 3 and 4 of these Regulations are made with the consent of the Treasury.
In accordance with section 34(5) of the Fire and Rescue Services Act 2004, the Welsh Ministers consulted such persons as they considered appropriate, in relation to regulation 5, before making these Regulations.
In accordance with section 21(1) of the 2013 Act, the Welsh Ministers have consulted the representatives of such persons as appear to the Welsh Ministers likely to be affected by regulations 3 and 4 of these Regulations.

To the extent required by section 27 of the Public Service Pensions and Judicial Offices Act 2022, regulation 4 of these Regulations is made in accordance with Treasury directions made under that section.
Title and coming into force

The title of these Regulations is the Firefighters’ Pension Schemes (Miscellaneous Amendments) (Wales) Regulations 2024.

These Regulations come into force on 21 October 2024.
Amendments to the Firefighters’ Pension Scheme (Wales) Regulations 2015

(1) The Firefighters’ Pension Scheme (Wales) Regulations 2015 are amended as follows.
(2) In regulation 3 (interpretation)—
(a) in the definition of “index adjustment”, in paragraph (a), after “earnings” insert “and the index supplement”;
(b) at the appropriate place insert—“
 “index supplement” (“atodiad mynegai”) means an amount of earned pension equal to the value of the index adjustment where the change in earnings is increased—
(a) for 2021, by 0.2% above the amount specified in the Public Service Pensions Revaluation Order 2021;
(b) for 2022, by 0.4% above the amount specified in the Public Service Pensions Revaluation Order 2022;”;
(c) in the definition of “in-service revaluation index”, at the end insert “and, in this scheme, includes the index supplement”.
Amendments to the Firefighters’ Pensions (Remediable Service) (Wales) Regulations 2023

(1) The Firefighters’ Pensions (Remediable Service) (Wales) Regulations 2023 are amended as follows.
(2) In regulation 22(2), in the definition of “legacy scheme amount”, after “section 29(2)” insert “of WRPA 1999”.
(3) In regulation 23(2)(b), in the Welsh language text, for “a’r swm amgen” substitute “ac mae’r swm amgen”.
(4) In regulation 29(1)(a), in the English language text, for “divorce, annulment” substitute “divorce or annulment”.
(5) In regulation 34(2)(a)—
(a) in the Welsh language text, for the comma following “rhwymedïol cyfan” substitute an opening parenthesis;
(b) after “regulation 42(2)” insert a closing parenthesis.
(6) In regulation 39(2), in the Welsh language text, after “pe bai’r hawliau hynny” insert “wedi bod”.
(7) In regulation 41(4), in the Welsh language text, for “adran 89(1)” substitute “adran 86(1)”.
(8) In regulation 46, in subparagraph (ii) of the substituted paragraph (2)(b), in the Welsh language text, for “nad yw’r” substitute “bod y”.
(9) In regulation 65(4), in the Welsh language text, for “gwasanaeth adferadwy”, in both places it occurs, substitute “gwasanaeth rhwymedïol”.
Amendment to the Welsh text of Schedule 1 (the New Firefighters’ Pension Scheme (Wales)) to the Firefighters’ Pension Scheme (Wales) Order 2007

In Schedule 1 to the Firefighters’ Pension Scheme (Wales) Order 2007, in Chapter 2 of Part 11, in rule 5C(7), in the Welsh language text, after “Pan” insert “nad”.
We consent to the making of regulations 3 and 4 of these Regulations.
