The Proceeds of Crime Act 2002 (Search, Seizure and Detention of Property: Code of Practice) (Northern Ireland) Order 2024

Coming into force 19th December 2024
The Secretary of State makes this Order in exercise of the powers conferred by section 195S(4) and (5) of the Proceeds of Crime Act 2002 (“the 2002 Act”).A draft of this instrument has been laid before Parliament under section 459(6)(a) of the 2002 Act and has been approved by a resolution of each House of Parliament.The Secretary of State has—
(a) under section 195S(5) of the 2002 Act, revised the code of practice made under section 195S(1) of the 2002 Act;
(b) in accordance with section 195S(2) of the 2002 Act, published a draft of the revised code of practice, considered any representations made about the draft and modified the draft as thought appropriate in the light of any such representations;
(c) in accordance with section 195S(2A) of the 2002 Act, consulted the Attorney General about the draft in its application to the exercise of powers by SFO officers and the Director of the Serious Fraud Office; and
(d) in accordance with section 195S(3) of the 2002 Act, laid the draft before Parliament.
Citation, commencement and extent

(1) This Order may be cited as the Proceeds of Crime Act 2002 (Search, Seizure and Detention of Property: Code of Practice) (Northern Ireland) Order 2024 and comes into force on the day after the day on which it is made.
(2) This Order extends to Northern Ireland.
Revised code of practice

The revised code of practice entitled “Code of Practice issued under section 195S of the Proceeds of Crime Act 2002: Search, Seizure and Detention of Property (Northern Ireland)” and laid before Parliament in draft on 31st October 2024 comes into operation on the day on which this Order comes into force.
Revocation
3 
The Proceeds of Crime Act 2002 (Search, Seizure and Detention of Property: Code of Practice) (Northern Ireland) Order 2021 is revoked.
