The Producer Responsibility Obligations (Packaging Waste) (Amendment) (England and Wales) Regulations 2022

Coming into force 1st January 2023

The Secretary of State makes these Regulations in exercise of the powers conferred by section 50 of, and paragraphs 1(1) and 2(2) of Schedule 4 to, the Environment Act 2021 (“the Act”).
The Secretary of State has consulted in accordance with paragraph 8(1) of Schedule 4 to the Act and is satisfied as to the matters specified in paragraph 9(1) of that Schedule.

The Secretary of State has the consent of Welsh Ministers to make these Regulations in accordance with section 50(3) of the Act.
Citation, commencement, extent and application

(1) These Regulations may be cited as the Producer Responsibility Obligations (Packaging Waste) (Amendment) (England and Wales) Regulations 2022 and come into force on 1st January 2023.
(2) These Regulations extend to and apply in relation to England and Wales only.
Amendment of the Producer Responsibility Obligations (Packaging Waste) Regulations 2007

(1) The Producer Responsibility Obligations (Packaging Waste) Regulations 2007 are amended as follows.
(2) In Schedule 2 (recycling obligations)—
(a) for paragraph 5 substitute—“
5. 
The percentage which is prescribed as the recycling target “X” for the year 2023 is 77%”;
(b) in paragraph 6—
(i) for “years” substitute “year”,
(ii) for Table 2 in paragraph 6 substitute—“

Plastic 61
Aluminium 69
Steel 87
Paper/Board 83
Wood 35”
(c) in paragraph 8 for “each of” to the end substitute “the year 2023.”
