
COMMISSION IMPLEMENTING DECISION (EU) 2020/1675 of 11 November 2020 amending Implementing Decision (EU) 2016/2323 establishing the European List of ship recycling facilities pursuant to Regulation (EU) No 1257/2013 of the European Parliament and of the Council (Text with EEA relevance) 

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1257/2013 of the European Parliament and of the Council of 20 November 2013 on ship recycling and amending Regulation (EC) No 1013/2006 and Directive 2009/16/EC, and in particular Article 16 thereof,
Whereas:

(1) Article 6(2) of Regulation (EU) No 1257/2013 requires ship owners to ensure that ships destined to be recycled are only recycled at ship recycling facilities included in the European List of ship recycling facilities published pursuant to Article 16 of that Regulation.

(2) The European List is set out in Commission Implementing Decision (EU) 2016/2323.

(3) Denmark has informed the Commission that a ship recycling facility located in its territory has been authorised by the competent authority, in accordance with Article 14 of Regulation (EU) No 1257/2013. Denmark has provided the Commission with all information relevant for that facility to be included in the European List. The European List should therefore be updated to include that facility.

(4) Norway has informed the Commission that a ship recycling facility located in its territory has been authorised by the competent authority, in accordance with Article 14 of Regulation (EU) No 1257/2013. Norway has provided the Commission with all information relevant for that facility to be included in the European List. The European List should therefore be updated to include that facility.

(5) The authorisation of a ship recycling facility located in Lithuania expired on 17 March 2020 and the Commission has received information from Lithuania that the facility does not continue ship recycling activities. The European List should therefore be updated to remove that facility.

(6) The authorisation of a ship recycling facility located in Latvia expired on 11 June 2020 and the Commission has received information from Latvia that the authorisation granted to that facility to conduct ship recycling has not been renewed. Therefore, the facility no longer meets the requirements set out in Article 13(1)(a) of Regulation (EU) No 1257/2013. The European List should therefore be updated to remove that facility.

(7) The authorisation of a ship recycling facility located in the United Kingdom expired on 2 July 2020 and the Commission has not received information from the United Kingdom that the authorisation granted to that facility to conduct ship recycling has been renewed. Therefore, the facility no longer meets the requirements set out in Article 13(1)(a) of Regulation (EU) No 1257/2013. The European List should therefore be updated to remove that facility.

(8) The authorisation of another ship recycling facility located in the United Kingdom expired on 6 October 2020 and the Commission has received information from the United Kingdom that the authorisation granted to that facility to conduct ship recycling has been renewed prior to its expiry, in accordance with Article 14 of Regulation (EU) No 1257/2013. However, following the withdrawal of the United Kingdom from the Union on 1 February 2020, ships flying the flag of a Member State of the European Union can no longer be recycled at that facility after the end of the transition period provided for under the Withdrawal Agreement on 31 December 2020. The date of expiry of the inclusion of that facility in the European List should therefore be updated accordingly, i.e. until 31 December 2020.

(9) The authorisation of another ship recycling facility located in the United Kingdom will expire on 2 November 2022. However, following the withdrawal of the United Kingdom from the Union on 1 February 2020, ships flying the flag of a Member State of the European Union can no longer be recycled at that facility after the end of the transition period provided for under the Withdrawal Agreement on 31 December 2020. The date of expiry of the inclusion of that facility in the European List should therefore be updated accordingly, i.e. until 31 December 2020.

(10) The authorisation of another ship recycling facility located in the United Kingdom expired on 3 August 2020 and the Commission has received information from the United Kingdom that the authorisation granted to that facility to conduct ship recycling has been renewed prior to its expiry, in accordance with Article 14 of Regulation (EU) No 1257/2013. Therefore, and considering that Regulation (EU) No 1257/2013 is made applicable to and in the United Kingdom in respect of Northern Ireland by the Protocol on Ireland/Northern Ireland, the facility can stay on the European List after the end of the transition period and until the date of expiry of the new authorisation. The date of expiry of the inclusion of that facility in the European List should therefore be updated accordingly.

(11) The authorisation of a ship recycling facility located in Spain expired on 28 July 2020 and the Commission has received information from Spain that the authorisation granted to that facility to conduct ship recycling has been renewed prior to its expiry, in accordance with Article 14 of Regulation (EU) No 1257/2013. The date of expiry of the inclusion of that facility in the European List should therefore be updated.

(12) The authorisation of two ship recycling facilities located in Lithuania expired on 17 March 2020 and on 21 May 2020, respectively, and the Commission has received information from Lithuania that the authorisation granted to those facilities to conduct ship recycling have been renewed prior to their expiry, in accordance with Article 14 of Regulation (EU) No 1257/2013. The date of expiry of the inclusion of those facilities in the European List should therefore be updated.

(13) The authorisation of a ship recycling facility located in Portugal expired on 26 July 2020 and the Commission has received information from Portugal that the authorisation granted to that facility to conduct ship recycling has been renewed prior to its expiry, in accordance with Article 14 of Regulation (EU) No 1257/2013. The date of expiry of the inclusion of that facility in the European List should therefore be updated.

(14) The authorisation of a ship recycling facility located in France will expire on 24 May 2021 and the Commission has received information from France that the authorisation granted to that facility to conduct ship recycling has been renewed, in accordance with Article 14 of Regulation (EU) No 1257/2013. The date of expiry of the inclusion of that facility in the European List should therefore be updated.

(15) The Commission has received applications, in accordance with Article 15(1) of Regulation (EU) No 1257/2013, for two ship recycling facilities located in Turkey to be included in the European List. Having assessed the information and supporting evidence provided or gathered in accordance with Article 15 of that Regulation, the Commission considers that the facilities comply with the requirements set out in Article 13 of that Regulation to conduct ship recycling and to be included in the European List. The European List should therefore be updated to include those facilities.

(16) Implementing Decision (EU) 2016/2323 should therefore be amended accordingly.

(17) The measures provided for in this Decision are in accordance with the opinion of the Committee established by Article 25 of Regulation (EU) No 1257/2013,
HAS ADOPTED THIS DECISION:

The Annex to Implementing Decision (EU) 2016/2323 is replaced by the text in the Annex to this Decision.
Article 2 
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
