The Education (National Curriculum) (Modern Foreign Languages) (Wales) Order 2008

The Welsh Ministers in exercise of the powers conferred on the National Assembly for Wales by sections 105(4) and (5) and 210 of the Education Act 2002 and now vested in them make the following Order:
Title, commencement and application

(1) The title of this Order is the Education (National Curriculum) (Modern Foreign Languages) (Wales) Order 2008 and it comes into force on 1 August 2008.
(2) This Order applies in relation to Wales.
Revocation

The Education (National Curriculum) (Modern Foreign Languages) (Wales) Order 2000 is revoked.
Meaning of modern foreign language
3 
For the purposes of section 105 of the Education Act 2002 “modern foreign language” means any modern foreign language.
Determination by the Welsh Ministers
4 

(1) Any question whether a particular foreign language is a modern foreign language for the purposes of section 105 of the Education Act 2002 is to be determined by the Welsh Ministers.
(2) The Welsh Ministers may make a determination under paragraph (1) following an application by any person or on their own initiative.
