The Education (National Curriculum for Wales) Disapplication of Science at Key Stage 4) Regulations 2006

Coming into force 1 August 2006
In exercise of the powers conferred on the National Assembly for Wales by sections 112 and 210(7) of the Education Act 2002, the National Assembly for Wales hereby makes the following Regulations:
Title, commencement and application

(1) The title of these Regulations is the Education (National Curriculum for Wales) (Disapplication of Science at Key Stage 4) Regulations 2005 and they come into force on 1 August 2006.
(2) They apply only to maintained schools in Wales.
Interpretation

(1) In these Regulations–
 “the 2002 Act” means the Education Act 2002;
 “ACCAC” (“ACCAC”) means the Qualifications, Curriculum and Assessment Authority for Wales or Awdurdod Cymwysterau, Cwricwlwm ac Asesu Cymru ;
 “the fourth key stage” (“y pedwerydd cyfnod allweddol”) is to be construed in accordance with section 103(1) of the 2002 Act;
 “maintained school” (“ysgol a gynhelir”) means a community, foundation or voluntary school or a community or foundation special school (other than one established in a hospital);
 “National Assembly” (“Cynulliad Cenedlaethol”) means the National Assembly for Wales; and
 “NQF” (“NQF”) means the National Qualifications Framework comprising qualifications accredited jointly by the National Assembly exercising functions formerly vested in ACCAC and the corresponding regulatory authorities for England and Northern Ireland , and “level” means the level (“lefel”) to which a qualification is accredited within the NQF.
(2) For the purposes of these Regulations, references to the requirements of the National Curriculum for Wales for science at the fourth key stage are references to the requirements of section 106(1) of the 2002 Act in so far as they apply to science.
Disapplication of Science at Key Stage 4

(1) Subject to regulation 4, the requirements of the National Curriculum for Wales for science at the fourth key stage are not to apply to a pupil at a maintained school at any time when the head teacher of the school is satisfied that the pupil is pursuing a course leading to the award of a relevant science qualification.
(2) For the purposes of paragraph (1), a qualification is a relevant science qualification if–
(a) it is, at the material time, approved under section 99 of the Learning and Skills Act 2000, for the purposes of section 96(2)(b) of that Act, as an external qualification the course leading to which may be provided by or on behalf of a maintained school, and
(b) the qualification is a qualification in science in the NQF at Entry level, level 1 or level 2.
Expiry of Regulations
4 

(1) These Regulations cease to apply at the end of July 2008.
