The Genetically Modified Organisms (Contained Use) (Amendment) Regulations 1998

The Secretary of State, being the Minister designated under section 2(2) of the European Communities Act 1972 in relation to the control and regulation of genetically modified organisms, in the exercise of the powers conferred on him by the said section 2 and section 15(1) of the Health and Safety at Work etc. Act 1974 (“the 1974 Act”) and of all other powers enabling him in that behalf and for the purpose of giving effect without modifications to proposals submitted to him by the Health and Safety Commission under section 11(2)(d) of the 1974 Act after the carrying out by the said Commission of consultations in accordance with section 50(3) of that Act, hereby makes the following Regulations:
Citation and commencement

These Regulations may be cited as the Genetically Modified Organisms (Contained Use) (Amendment) Regulations 1998 and shall come into force on 22nd July 1998.
Amendments to the Genetically Modified Organisms (Contained Use) Regulations 1992

In regulation 6 of the Genetically Modified Organisms (Contained Use) Regulations 1992—
(a) at the end of paragraph (2)(a)(ii), for the word “and” substitute “or”; and
(b) after paragraph (2)(a)(ii) insert the following paragraph—“
(iii) a novel food or novel food ingredient marketed in accordance with the provisions of Regulation (EC) No. 258/97 of the European Parliament and the Council; or”.
