The Social Security (Guardian’s Allowances) (Amendment) Regulations (Northern Ireland) 1998

Coming into operation 31st August 1998
The Department of Health and Social Services for Northern Ireland, in exercise of the powers conferred on it by sections 77(8)(a) and 171(1) and (3) to (5) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992 and of all other powers enabling it in that behalf, hereby makes the following Regulations:
Citation, commencement and interpretation

(1) These Regulations may be cited as the Social Security (Guardian’s Allowances) (Amendment) Regulations (Northern Ireland) 1998 and shall come into operation on 31st August 1998.
(2) The Interpretation Act (Northern Ireland) 1954 shall apply to these Regulations as it applies to a Measure of the Northern Ireland Assembly.
Amendment of the Social Security (Guardian’s Allowances) Regulations

In regulation 4(1) of the Social Security (Guardian’s Allowances) Regulations (Northern Ireland) 1975 (children of divorced persons, etc.) for the words from “there was no order” to “of the Act” there shall be substituted—“
 there was neither—
(a) an order of a court granting custody of the child to that other parent or imposing any liability on him for the child’s maintenance; nor
(b) a maintenance assessment as defined in Article 2(2) of the Child Support (Northern Ireland) Order 1991 in force in respect of that other parent and the child,then section 77(2) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992”.
