The Education (National Curriculum) (Assessment Arrangements for Key Stages 1, 2 and 3) (England) (Amendment) Order 1997

Coming into force 1st October 1997
In exercise of the powers conferred on the Secretary of State by sections 356(2)(c), (5) and (6) and 568(1), (3) and (5) of the Education Act 1996, the Secretary of State for Education and Employment hereby makes the following Order:
Citation, commencement and interpretation

(1) This Order may be cited as the Education (National Curriculum) (Assessment Arrangements for Key Stages 1, 2 and 3) (England) (Amendment) Order 1997 and shall come into force on 1st October 1997.
(2) In this Order—
 “QCA” means the Qualifications and Curriculum Authority established under section 21 of the Education Act 1997;
 “SCAA” means the School Curriculum and Assessment Authority established under section 244 of the Education Act 1993 and continued in existence by section 358 of the Education Act 1996;
 “the effective date” means the date on which this Order comes into force;
 “the principal Orders” means the Education (National Curriculum) (Assessment Arrangements for the Core Subjects) (Key Stage 1) (England) Order 1995, the Education (National Curriculum) (Assessment Arrangements for the Core Subjects) (Key Stage 2) (England) Order 1995 and the Education (National Curriculum) (Key Stage 3) (Assessment Arrangements) (England) Order 1996.
Amendment of principal Orders

In article 3(1) (Interpretation) of each of the principal Orders, for the definition of “the Authority” there shall be substituted the following definition—“
 “the Authority” means the Qualifications and Curriculum Authority established under section 21 of the Education Act 1997;”.
Transitional Provision
3 
Anything done, or in the process of being done, by or in relation to SCAA before the effective date for the purposes of or in connection with any of the functions bestowed on the Authority by the principal Orders, shall, from that date, be treated as having been done by or in relation to QCA or, as the case may be, be continued by or in relation to QCA.
