(1) This Order may be cited as the Wildlife and Countryside Act 1981 (Variation of Schedule 9) (England) (No. 2) Order 2021 and comes into force on 31st May 2021.
(2) This Order extends to England and Wales.

(1) Schedule 9 (animals and plants to which section 14 applies) to the Wildlife and Countryside Act 1981 is varied as follows.
(2) In Part 1 (non-native animals which are established in the wild), after the entry for “Zander” insert—“
With respect to any area in England which on 31st May 2021—
(a) is a European site within the meaning of regulation 8 of the Conservation of Habitats and Species Regulations 2017, or
(b) is within 500 metres of the boundary of a site described in paragraph (a)— 

(i) Partridge, Red-legged
(ii) Pheasant, Common 
(i) Alectoris rufa
(ii) Phasianus colchicus”.

(1) Before 30th May 2024, the Secretary of State must—
(a) carry out a review of the effectiveness of the variation of Schedule 9 made by this Order;
(b) set out the conclusions of the review in a report; and
(c) publish the report.
(2) The report must in particular—
(a) set out the objectives intended to be achieved by this Order;
(b) assess the extent to which those objectives are achieved; and
(c) assess whether those objectives remain appropriate and, if so, the extent to which they could be achieved in a less burdensome way.
