(1) This Order may be cited as the Tobacco and Primary Medical Services (Scotland) Act 2010 (Commencement No. 3) Order 2013 and comes into force on 18th February 2013.
(2) In this Order—
 “large shop” means a shop which has a relevant floor area exceeding 280 square metres;
 “relevant floor area”, in relation to a shop, means the internal floor area of so much of the shop as consists of or is comprised in a building but excluding any part of the shop which is used neither for the serving of customers in connection with the sale of goods nor for the display of goods; and
 “shop” means any place where there is carried on a trade or business consisting wholly or mainly of the sale of goods.

The days appointed for the coming into force of the following provisions of the Tobacco and Primary Medical Services (Scotland) Act 2010 are—
(a) 26th February 2013 for sections 1 (prohibition of tobacco displays etc.), 2 (displays which are also advertisements) and 3 (regulation of display of prices) but only for the purpose of enabling the Scottish Ministers to make regulations under sections 1(2)(c), (3)(b) and (4), 2 and 3(1), (2) and (5);
(b) 29th April 2013 for sections 1, 2 and 3 but only for the purposes of large shops; and
(c) 6th April 2015 for sections 1, 2 and 3 for all other purposes.
