(1) This Order may be cited as the Disability Discrimination (Guidance on the Definition of Disability) (Revocation) Order (Northern Ireland) 2008 and shall come into operation on 21st April 2008.
(2) In this Order—
 “the 1995 Act” means the Disability Discrimination Act 1995.
(3) The Interpretation Act (Northern Ireland) 1954 shall apply to this Order as it applies to an Act of the Assembly.

Subject to article 3, the Guidance on matters to be taken into account in determining questions relating to the definition of disability (ISBNNo. 0-337-09436-5) referred to in article 2 of the Disability Discrimination (Guidance and Code of Practice) (Appointed Day) Order (Northern Ireland) 1996 is revoked.

The Guidance referred to in article 2 is to continue to have effect after 20th April 2008 for the purposes of section 3(3) of the 1995 Act in relation to any proceedings arising from a complaint (whenever presented) alleging that a person has, before 21st April 2008, committed an act which is unlawful discrimination for the purposes of the 1995 Act or of Part III of the Special Educational Needs and Disability (Northern Ireland) Order 2005.
