(1) These Regulations may be cited as the Northern Ireland Social Care Council (Social Care Workers) Regulations (Northern Ireland) 2006 and shall come into operation on 23rd October 2006.
(2) In these Regulations—
 “the Act” means the Health and Personal Social Services Act (Northern Ireland) 2001; and
 “regulatory body” means, in relation to any profession, the body (or main body) responsible for the regulation of the profession.

(1) A person who is registered for the time being with or (as the case may be) is a member of one or more of the regulatory bodies specified in paragraph (2) is excepted from the meaning of social care worker for the purposes of section 2(2) of the Act.
(2) For the purposes of paragraph (1) the regulatory bodies are—
(a) the General Chiropractic Council;
(b) the General Dental Council;
(c) the General Medical Council;
(d) the General Optical Council;
(e) the General Osteopathic Council;
(f) the General Teaching Council;
(g) the General Teaching Council for Northern Ireland;
(h) the General Teaching Council for Scotland;
(i) the General Teaching Council for Wales;
(j) the Health Professions Council;
(k) the Nursing and Midwifery Council;
(l) the Pharmaceutical Society of Northern Ireland;
(m) the Royal Pharmaceutical Society of Great Britain; and
(n) any other regulatory body established by Order in Council under section 60 of the Health Act 1999.

For the purposes of section 2(3) of the Act (“Social care worker”, etc.), persons of any of the descriptions in paragraphs (a) to (e) of subsection (3) of section 2 of the Act shall, subject to regulation 2, be treated as social care workers.
