These Regulations may be cited as the Education (Student Support) (Amendment) Regulations (Northern Ireland) 2006 and shall come into operation on 20th September 2006.

In these Regulations “the principal Regulations” means the Education (Student Support) Regulations (Northern Ireland) 2006 .

The principal Regulations shall be amended as provided by regulations 4 to 15.

In regulation 1 (Citation and commencement) after the word “on” there shall be inserted “1st September”.

(1) Regulation 16 (Availability of fee loans to new system students – general) shall be amended as provided by paragraphs (2) and (3).
(2) In paragraph (2) the words “or (b)” shall be omitted.
(3) In paragraph (5) for the words “regulation 17, 18 or 19” there shall be substituted “regulation 17, 17A, 18 or 19”.

For Regulation 17 (Standard entitlement of new system students who have not studied on a previous course) there shall be substituted—“
17. 
“Subject to regulation 17A, the standard entitlement of a new system student who has not studied on a previous course is calculated as follows—OD+1where
 OD is the number of academic years that make up the ordinary duration of the current course.”

After regulation 17 there shall be inserted—“
17A. 

(1) Where the current course is a course leading to a degree in social work at an educational institution in Northern Ireland, the standard entitlement of a new system student is as follows—OD+1where
OD is the number of academic years that make up the ordinary duration of the current course.
(2) Paragraph (1) also applies where—
(a) the current course in relation to that student falls under paragraph (a) of the definition of “end-on course”; or
(b) the student has studied on a previous course other than a course mentioned in sub-paragraph (a).
(3) Where this regulation applies, regulations 18 and 19 do not apply.”

In regulation 19 (Standard entitlement of new system students on end-on courses and certain degree courses), in paragraph (2) after the words “Regulations 17” there shall be inserted “, 17A”.

(1) Regulation 23 (End-on courses) shall be amended as provided by paragraphs (2) to (4).
(2) After paragraph (4) there shall be inserted—“
(4A) Notwithstanding paragraph (4) (a) an old system student qualifies for fee support in respect of a course leading to a degree in social work at an educational institution in Northern Ireland.”
(3) At the beginning of paragraph (7) there shall be inserted “Subject to paragraph 7A, ”.
(4) After paragraph (7) there shall be inserted—“
(7A) The standard entitlement of an old system student to whom paragraph (3) (a) applies whose course is a course leading to a degree in social work at an educational institution in Northern Ireland is calculated as follows—OD+1whereOD is the number of academic years that make up the ordinary duration of the current course.”

In regulation 24 (Gap year students who have not studied on a previous course), after paragraph (2) there shall be inserted—“
(2A) Notwithstanding paragraph (2) (a) an old system student qualifies for fee support in respect of a course leading to a degree in social work at an educational institution in Northern Ireland.”

(1) Regulation 25 (Gap year students who have studied on a previous course) shall be amended as provided by paragraphs (2) to (4).
(2) After paragraph (2) there shall be inserted—“
(2A) Notwithstanding paragraph (2) (a) an old system student qualifies for fee support in respect of a course leading to a degree in social work at an educational institution in Northern Ireland.”
(3) At the beginning of paragraph (5) there shall be inserted “Subject to paragraph 5A,”.
(4) After paragraph (5) there shall be inserted —“
(5A) The standard entitlement of an old system student to whom paragraph (5) applies whose course is a course leading to a degree in social work at an educational institution in Northern Ireland is calculated as follows—OD+1whereOD is the number of academic years that make up the ordinary duration of the current course.”

In regulation 27 (Amount of the grant for fees for a course at a publicly-funded institution in the United Kingdom or relevant institution of higher education in the Republic of Ireland)—
(a) for paragraph (4) there shall be substituted “Paragraphs (1) to (3) do not apply to designated courses at Heythrop College or at Guildhall School of Music and Drama.”;
(b) after paragraph (5) of regulation 27 there shall be inserted—“
(5A) In the case of a designated course at Guildhall School of Music and Drama, the amount of the grant for fees in respect of an academic year is £4,355.”.

In regulation 29 (Amount of the grant for fees for a course at a private institution)—
(a) in paragraph (1) for the words “Subject to paragraphs (2) and (3)” there shall be substituted “Subject to paragraph (2)”;
(b) paragraph (3) shall be omitted.

In regulation 30 (Availability of fee contribution loans to old system students) after “Ireland,” there shall be inserted “or whose course is a course leading to a degree in social work at an educational institution in Northern Ireland”.

(1) Regulation 53 (Qualifying conditions for and amounts of the higher education bursary) shall be amended as provided by paragraphs (2) and (3).
(2) For paragraph (1) there shall be substituted—“
(1) Subject to paragraph (2), an old system student who qualifies for a grant for fees under regulation 21 and who is under the age of 60 on the relevant date qualifies for a higher education bursary in accordance with his attendance on a designated course.”.
(3) Paragraphs (4) to (6) shall be omitted.
