These Regulations may be cited as the Common Agricultural Policy Single Payment and Support Schemes (Amendment) Regulations (Northern Ireland) 2006, and shall come into operation on 10th May 2006.

(1) The Interpretation Act (Northern Ireland) 1954  shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.
(2) In these Regulations, “the principal Regulations” means the Common Agricultural Policy Single Payment and Support Schemes Regulations (Northern Ireland) 2005.

The principal Regulations shall be amended as specified in regulation 4.

(1) In regulation 2(2) (Interpretation)—
(a) for the definition of “Commission Regulation 795/2004” substitute the following—“
 “Commission Regulation 795/2004” means Commission Regulation (EC) No. 795/2004 laying down detailed rules for the implementation of the single payment scheme provided for in the Council Regulation, as last amended by Commission Regulation (EC) No. 658/2006;”;
(b) for the definition of “Commission Regulation 796/2004” substitute the following—“
 “Commission Regulation 796/2004” means Commission Regulation (EC) No. 796/2004 laying down detailed rules for the implementation of cross-compliance, modulation and the integrated administration and control system provided for in the Council Regulation, as last amended by Commission Regulation (EC) No. 659/2006;”;
(c) at the end of the definition of “Commission Regulation 1973/2004” add the words “, as last amended by Commission Regulation (EC) No. 660/2006”;
(d) at the end of the definition of “Council Regulation” add the words “, as last amended by Council Regulation (EC) No.319/2006”.
(2) Regulation 2(4) shall be omitted.
(3) Regulation 6 shall be substituted by the following—“

(1) For the purposes of Article 24(2) of Commission Regulation 795/2004, a farmer may choose up to two dates for the beginning of the 10 month period referred to in Article 44(3) of the Council Regulation in respect of his holding.
(2) Such dates must be within the period beginning on 1st October of the calendar year preceding the year in which the farmer submitted an application under the single payment scheme and ending on 30th April of the year of application.
(3) If a farmer does not choose a date for the beginning of the 10 month period in respect of his holding, that period shall begin on 1st February of the year of application.”.
