(1) This Order may be cited as the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (Scotland) Order 2003 and shall come into force at 1700 hours on 25th April 2003.
(2) In this Order–
(a) “scallops” means scallops of the class of Pecten maximus; and
(b) “relevant time” means 0001 hours on 25th April 2003.

In the opinion of the Scottish Ministers, scallops in the areas designated in article 3 below may be affected by the toxin which causes amnesic shellfish poisoning in human beings and are likely to create a hazard to human health if they are consumed.

The areas described in the Schedule to this Order are hereby designated for the purposes of Part I of the Food and Environment Protection Act 1985.

No person shall fish for or take any scallops in the designated areas.
5 
No person shall move any scallops out of the designated areas.
6 
No person shall–
(a) use any scallops taken out of the designated areas after the relevant time in the preparation or processing for supply of food and anything from which food could be derived;
(b) land any scallops which were in waters in the designated areas after the relevant time;
(c) supply, or have in possession for supply, any scallops which were in the designated areas after the relevant time;
(d) supply, or have in possession for supply, any food or anything from which food could be derived in the preparation or processing of which anything was used in contravention of paragraph (a) of this article; or
(e) feed to any creature a feeding stuff in the preparation or processing of which anything was used in contravention of paragraph (a) of this article.

The area of sea below mean high water springs enclosed by a line starting from a point on the north west coast of Lewis at 58°14.3−North latitude 7°West longitude; then north to 58°15−North latitude 7°West longitude; then east to a point on the west coast of Great Bernera at 58°15−North latitude 6°53.5−West longitude; then south, east and north along the shoreline of Great Bernera to 58°15−North latitude 6°50.5−West longitude; then east to a point on the Lewis shore at 58°15−North latitude 6°48−West longitude; then south, west and north along the shoreline to the point of beginning.

The area of water below mean high water springs within Loch Erisort enclosed by a line starting from a point on the north shore of the Loch at 58°06.2−North latitude 6°30−West longitude; south to a point on the south shore of the loch at 58°05.6−North latitude 6°30−West longitude; then west, north and east along the shoreline of the loch to the point of the beginning.

The area of water below mean high water springs within Loch Shell enclosed by a line starting from a point on the north shore of the loch at 58°00.4−North latitude 6°30−West longitude; then south to a point on the south shore of the loch at 58°00.1−North latitude 6°30−West longitude; then west, north and east along the shoreline to the point of beginning.

The area of water below mean high water springs within Loch Seaforth enclosed by a line starting from a point on the east shore of the loch at 58°North latitude 6°42.2−West longitude; then west to a point on the east shore of Seaforth Island at 58°North latitude 6°42.8−West longitude; then north, west and south along the shoreline to 58°North latitude 6°44.2−West longitude; then west to a point on the western shore of Loch Seaforth at 58°North latitude 6°45−West longitude; the north, east and south along the shoreline to the point of beginning.

The area of water below mean high water springs within Loch Resort enclosed by a line starting from a point on the south shore of the loch at 58°02.3−North latitude 7°West longitude; then north to a point on the north shore of the loch at 58°02.6−North latitude 7°West longitude; then east, south and west along the shoreline to the point of beginning.

The area of water below high water springs enclosed by a line starting from a point at 58°North latitude 7°30−West longitude; then east to a point on the shore of Harris at 58°North latitude 7°05−West longitude; then south along the shoreline to 57°57−North latitude 7°West longitude; then south to a point on the shore of Taransay 57°55.2−North latitude 7°West longitude; then east, south and west along the shoreline to 57°53.3−North latitude 7°West longitude; then south to a point on the shore of Harris at 57°51−North latitude 7°West longitude; then west and south along the shoreline to 57°45−North latitude 7°West longitude; then west to 57°45−North latitude 7°30−West longitude; then north to the point of beginning.
