These Regulations may be cited as the Police and Police (Special Constables) (Scotland) Amendment Regulations 2003 and shall come into force on 3rd February 2003.

In regulation 6 of the Police (Scotland) Regulations 1976 (qualifications for appointment of constables)–
(a) after paragraph (a) there is inserted–“
(aa) if not a national of a State which is a Contracting Party to the Agreement on the European Economic Area signed at Oporto on 2nd May 1992 as adjusted by the Protocol signed at Brussels on 17th March 1993, has leave to enter or remain in the United Kingdom for an indefinite period;”; and
(b) in paragraph (c) after “sufficiently educated” there is inserted “, including being sufficiently competent in written and spoken English and sufficiently numerate,”.

In regulation 4 of the Police (Special Constables) (Scotland) Regulations 1966 (qualifications for appointment)–
(a) for paragraph (b) there is substituted–“
(b) he, if not a national of a State which is a Contracting Party to the Agreement on the European Economic Area signed at Oporto on 2nd May 1992 as adjusted by the Protocol signed at Brussels on 17th March 1993, has leave to enter or remain in the United Kingdom for an indefinite period”; and
(b) for paragraph (e) there is substituted–“
(e) he has satisfied the chief constable that he has attained a reasonable standard of education, including being sufficiently competent in written and spoken English”.
