These Regulations may be cited as the Social Security (Incapacity) (Miscellaneous Amendments No. 2) Regulations (Northern Ireland) 2002 and shall come into operation –
(a) except for the purposes of regulation 3(3), on 1st October 2002; and
(b) for the purposes of regulation 3(3), on 1st January 2003.

In regulation 14 of the Social Security (General Benefit) Regulations (Northern Ireland) 1984 (earnings level for the purpose of unemployability supplement) for “£3,432·00” there shall be substituted “£3,510·00”.

(1) The Social Security (Incapacity Benefit) Regulations (Northern Ireland) 1994 shall be amended in accordance with paragraphs (2) and (3).
(2) In regulation 7 (limit of earnings from councillor’s allowance) for “£66·00” there shall be substituted “£67·50”.
(3) In regulation 17(4) (circumstances in which a previous claimant who does not satisfy the age condition becomes entitled) –
(a) sub-paragraph (c) shall be omitted; and
(b) for sub-paragraph (d) there shall be substituted the following sub-paragraph –“
(d) who made his claim for benefit on a day not later than 3 months from the end of the period of 196 days described in sub-paragraph (b).”.

In regulation 17(2)(a) of the Social Security (Incapacity for Work) (General) Regulations (Northern Ireland) 1995 (exempt work) for “£66·00” there shall be substituted “£67·50”.

Regulations 2, 3(3), 4 and 5 of the Social Security (Incapacity Benefit) (Miscellaneous Amendments) Regulations (Northern Ireland) 2001 are hereby revoked.
