(1) These Regulations may be cited as the Day Care and Child Minding (Inspections) (Prescribed Matters) (England) Regulations 2001.
(2) These Regulations shall come into force on 1st September 2001.
(3) These Regulations extend to England only.

In these Regulations, “the Act” means the Children Act 1989.

The prescribed interval for the purposes of section 79Q(2) and (3) of the Act (duty on the Chief Inspector to secure that child minding provided in England, and day care provided on premises in England, by a registered person is inspected by a registered inspector at prescribed intervals) is two years.

(1) The prescribed period for the purposes of section 79R(1) of the Act (the period within which the person who has conducted an inspection under section 79Q must report to the Chief Inspector) is 25 days beginning on the day following that on which the inspection is completed.
(2) For the purpose of calculating the period prescribed by paragraph (1), no account shall be taken of any day which is a Saturday, Sunday, Good Friday, or Christmas Day or any day which is a bank holiday in England under the Banking and Financial Dealings Act 1971.

For the purpose of section 79R(3)(b) of the Act, (authorities or persons to whom the Chief Inspector shall send a copy of the report or of parts of the report),—
(a) the prescribed authority is the local authority for the area in which the child minding or day care which is the subject of the report is provided; and
(b) the prescribed person is the registered person whose provision of child minding or day care is the subject of the report.
