(1) These Regulations may be cited as the Education (Teacher Training Hardship Grants) (England) (No.2) Regulations 2001 and shall come into force 1st September 2001.
(2) These Regulations shall only apply in relation to England.
(3) In these Regulations:
 “the Agency” means the Teacher Training Agency;
 “governing body” in relation to an institution conducted by a company, shall be construed in accordance with any order under section 4(3) of the Education Act 1994; and
 “institution” means an eligible institution within the meaning of section 4(2) of the Education Act 1994.

(1) The Agency may pay grants to the governing bodies of institutions providing initial teacher training to facilitate and encourage the training of a person as a teacher in accordance with the following provisions of these Regulations.
(2) Grant may only be paid in respect of expenditure approved by the Agency and incurred by the governing body of an institution in relieving financial hardship suffered by students undertaking, or proposing to undertake, courses of initial teacher training at the institution.
(3) For the purposes of paragraph (2) a student suffers financial hardship if he is in such serious financial difficulties that his access to a course or his continued attendance on a course may be at risk.

The making of a payment shall be dependent on the fulfilment of such conditions as may be determined by the Agency.

Where in the opinion of the Agency any information or assumption on the basis of which grant has been paid is incorrect, the governing body to whom the grant was paid shall at the request of the Agency repay such sums not exceeding the total grant as the Agency may request.

The Education (Teacher Training Hardship Grants) (England) Regulations 2001 are revoked.
