These Regulations may be cited as the Beef (Marketing Payment) (No. 2) (Amendment) Regulations 1997 and shall come into force on 4th February 1997.

(1) The Beef (Marketing Payment) (No. 2) Regulations 1996 shall be amended in accordance with this regulation.
(2) Regulation 3(1) shall be replaced by the following—“
(1) Subject to the following provisions of these Regulations, the appropriate Minister may make a payment to a beef producer in respect of any heifer, steer or bull—
(a) kept prior to 20th March 1996 on a holding belonging to that producer;
(b) which was—
(i) sold by that producer after 30th June 1996 and before 1st October 1996 for slaughter for human consumption;
(ii) slaughtered by that producer or on his behalf after 19th March 1996 and before 1st October 1996 for sale for human consumption;
(iii) sold by that producer after 30th September 1996 and before 10th November 1996 for slaughter for human consumption; or
(iv) slaughtered by that producer or on his behalf after 30th September 1996 and before 10th November 1996 for sale for human consumption;
(c) for which no payment has previously been made under the Beef (Marketing Payment) Regulations 1996 or under these Regulations; and
(d) the carcase of which was, at the date of slaughter, within category A, B, C, or E as defined in Article 3 of Council Regulation (EEC) No. 1208/81 determining the Community scale for the classification of carcases of adult bovine animals, as amended by Council Regulation (EEC) No. 1026/91.”.
(3) In regulation 4(2) there shall be inserted after “1997” the words “or, in the case of an application in respect of an animal satisfying either of the conditions specified in regulation 3(1)(b)(iii) and (iv), by 24th February 1997”.
