These Regulations may be cited as the Novel Foods and Novel Food Ingredients (Fees) Regulations 1997 and shall come into force on 16th June 1997.

In these Regulations—
 “Minister” means the Minister of Agriculture, Fisheries and Food.

Any person who, pursuant to Article 4.1 of Regulation (EC) No. 258/97 of the European Parliament and of the Council, concerning novel foods and novel food ingredients, and regulation 3 (requests relating to novel foods or novel food ingredients and designation of food assessment body) of the Novel Foods and Novel Food Ingredients Regulations 1997, submits to the Minister a request relating to a novel food or novel food ingredient, shall, at the time he submits that request, pay to the Minister, in connection with the services provided by him acting jointly with the Secretary of State for Health as the food assessment body for the purposes of that Regulation, the appropriate fee prescribed in regulation 4 below.

(1) In respect of a request relating to any application involving a genetically modified organism for which an environmental risk assessment is required the fee payable shall be £6,500.
(2) In respect of a request relating to any other application the fee payable shall be £4,000.
(3) In respect of a request for an opinion as to substantial equivalence the fee payable shall be £1,725.
