This Order may be cited as the Food Safety (Enforcement) Order (Northern Ireland) 1997 and shall come into operation on 8th December 1997.

In this Order —
“dairy farm”—
(a) means any farm on which milk is produced, but
(b) does not include any part of any such premises on which milk is manufactured into other products;
 “licensed premises” means premises licensed under the Poultry Meat, Farmed Game Bird Meat and Rabbit Meat (Hygiene and Inspection) Regulations (Northern Ireland) 1995, the Fresh Meat (Hygiene and Inspection) Regulations (Northern Ireland) 1997 or the Wild Game Meat (Hygiene and Inspection) Regulations (Northern Ireland) 1997;
 “liquid milk plant”—
(a) includes any premises—
(i) in which milk is received, stored, treated, processed and packaged; or
(ii) from which milk is supplied or distributed for sale; or
(iii) in which milk is kept or used for purposes of sale; or
(iv) in which vessels and equipment used for the sale of milk are kept, but
(b) does not include—
(i) any part of any such premises on which milk is manufactured into other products, or
(ii) premises from which milk is sold by retail;
 “meat plant” means—
(a) licensed premises;
(b) premises approved under the Minced Meat and Meat Preparations (Hygiene) Regulations (Northern Ireland) 1997 or the Meat Products (Hygiene) Regulations (Northern Ireland) 1997; or
(c) premises registered under the Food Premises (Registration) Regulations (Northern Ireland) 1992 and in which minced meat or meat preparations are produced;
 “meat preparations” has the meaning assigned to it by regulation 2 of the Minced Meat and Meat Preparations (Hygiene) Regulations (Northern Ireland) 1997;
 “meat products” has the meaning assigned to it by regulation 2(1) of the Meat Products (Hygiene) Regulations (Northern Ireland) 1997;
 “milk” includes cream and skimmed, semi-skimmed or separated milk;
 “minced meat” has the meaning assigned to it by regulation 2 of the Minced Meat and Meat Preparations (Hygiene) Regulations (Northern Ireland) 1997;
 “other products of animal origin” has the meaning assigned to it by regulation 2(1) of the Meat Products (Hygiene) Regulations (Northern Ireland) 1997.

(1) For the purposes of Article 26(1A) of the Food Safety (Northern Ireland) Order 1991 and subject to paragraph (2) the whole of that Order is specified in the case of—
(a) dairy farms;
(b) liquid milk plants;
(c) the importation of milk;
(d) the transport of milk;
(e) meat plants other than—
(i) meat plants which are not, and do not share a common curtilage with, licensed premises and which are used exclusively for the production or storage of one or more of the following—(aa) meat products;(bb) minced meat which is not intended for sending out of the United Kingdom;(cc) meat preparations;(dd) other products of animal origin;
(ii) meat plants or parts of meat plants which are, or share a common curtilage with, licensed premises and which are used exclusively for the production or storage of one or more of the following—(aa) meat products;(bb) other products of animal origin.
(2) Paragraph (1)(e) shall apply only in relation to the Department of Agriculture’s functions under the Poultry Meat, Farmed Game Bird Meat and Rabbit Meat (Hygiene and Inspection) Regulations (Northern Ireland) 1995, the Fresh Meat (Hygiene and Inspection) Regulations (Northern Ireland) 1997, the Wild Game Meat (Hygiene and Inspection) Regulations (Northern Ireland) 1997, the Meat Products (Hygiene) Regulations (Northern Ireland) 1997 and the Minced Meat and Meat Preparations (Hygiene) Regulations (Northern Ireland) 1997.
