(1) This Order may be cited as the Transfer of Functions (Foreign Service Allowance) Order 1996.
(2) This Order shall come into force on 1st April 1996.

(1) The function of the Treasury under section 319 of the Income and Corporation Taxes Act 1988 (Crown servants: foreign service allowance) shall be exercisable concurrently with the Secretary of State, the Lord Chancellor, the Chancellor of the Exchequer, the Minister of Agriculture, Fisheries and Food, the Minister for the Civil Service, the Lord President of the Council, the Lord Privy Seal, the Attorney General and the Lord Advocate.
(2) Section 319 shall become section 319(1) and—
(a) the words “by the Treasury” shall be omitted; and
(b) at the end there shall be added—“
(2) A certificate under subsection (1) shall be given by the Treasury, the Secretary of State, the Lord Chancellor, the Chancellor of the Exchequer, the Minister of Agriculture, Fisheries and Food, the Minister for the Civil Service, the Lord President of the Council, the Lord Privy Seal, the Attorney General or the Lord Advocate.”.
