(1) These Regulations, which may be cited as the National Disability Council (No. 2) Regulations 1996, shall come into force on 25th June 1996.
(2) In these Regulations, “the Council” means the National Disability Council established by section 50 of the Disability Discrimination Act 1995.

The Secretary of State may, at the request of the Council, commission research to be undertaken on the Council’s behalf to assist it in the fulfilment of its statutory duties.

The Council may appoint a person to act as an adviser to the Council in the following circumstances and subject to the following conditions—
(a) that the person to be appointed has a specialist skill or knowledge which is necessary to assist the Council in the fulfilment of its statutory duties;
(b) that none of the members of the Council has such a specialist skill or knowledge;
(c) that the advice which the Council requires from the person to be appointed is not the function of its members or its staff to provide, and is not otherwise to be provided to the Council under any of the provisions of Schedule 5 to the Disability Discrimination Act 1995;
(d) that except in exceptional circumstances where a longer period of appointment is necessary, the appointment does not exceed 12 months;
(e) that the appointment is made in accordance with procedures agreed between the Council and the Secretary of State;
(f) that the Secretary of State is satisfied that the circumstances in (a) to (c) above apply and that the conditions in (d) and (e) above are met.
