(1) These Regulations may be cited as the Cosmetic Products (Safety) (Amendment) Regulations 1994 and except as provided by paragraph (2) below shall come into force on 30th June 1994.
(2) Regulations 2(b), 2(d), 2(f)(ii) and 2(g)(ii) shall come into force—
(a) on 1st July 1994 in relation to the supply of cosmetic products by the manufacturer in or importer into the United Kingdom, or in the case of cosmetic products manufactured or imported into the United Kingdom on behalf of another person, by that other person, except where the cosmetic products are supplied by retail in which case they shall come into force on 30th June 1995; and
(b) in all other cases on 30th June 1995.

The Cosmetic Products (Safety) Regulations 1989 are hereby amended—
(a) in regulation 2(1) in the definition of “the Directive” by the substitution for “and” of “,” between the words “92/8/EEC(k)” and “Commission Directive 92/86/EEC(1)” and by the addition of the words “and Commission Directive No 93/47/EEC(m)” at the end of the definition and by the insertion as a footnote at the foot of the relevant page the following—“
(m) O.J. L203 13.8.93, p. 24.”;
(b) in Schedule 1 by the insertion after entry number 38 of the following—“
38A 4-Amino-2-nitrophenol — 412”;
(c) in Schedule 2, Part I—
(i) in column 6 of entry numbers 8, 9 and 10, where these relate to oxidizing colouring agents for hair dyeing for professional use, by the addition of—“
 Wear suitable gloves.”;
(ii) in column 6 of entry number 12 by the addition of—“
(a) : Wear suitable gloves.”;
(d) in Schedule 2, Part II by the insertion after entry number 5 of the following—“
6 Strontium peroxide Rinsed-off hair care preparations, professional use 4.5% calculated as strontium in the ready-to-use preparation All products must meet the hydrogen peroxide release requirements Professional use only. (ii) by the insertion after entry number 7 of the following—“

(g) in Schedule 5, Part II—
(i) by the deletion of entry number 31;
(ii) by the insertion after entry number 32 of the following—“

(iii) in entry numbers 2, 5, 6, 12, 13, 17, 24, 25, 26, 28, 29 and 32 by the substitution for “30.6.1993” of “30.6.1994”;
(h) in Schedule 6
(i) in paragraph 1 by the insertion after “Directive No.85/490/EEC(e);” of the following—
 “Annex E means the Annex to Commission Directive No. 93/73/EEC(g);” and by the insertion as a footnote at the foot of the relevant page of “(g) O.J. No. L231, 14.9.93, p.34.”;
(ii) in paragraph 6 by the addition after entry number 32 of the following—“
(33) Any test for the identification and determination of silver nitrate in a cosmetic product shall be carried out in accordance with that part of Annex E which is headed “Identification and determination of silver nitrate in cosmetic products”.
(34) Any test for the identification and determination of selenium disulphide in anti-dandruff shampoos shall be carried out in accordance with that part of Annex E which is headed “Identification and determination of selenium disulphide in anti-dandruff shampoos”.
(35) Any test for the determination of soluble barium and soluble strontium in pigments in the form of salts or lakes shall be carried out in accordance with that part of Annex E which is headed “Determination of soluble barium and strontium in pigments in the form of salts or lakes”.
(36) Any test for the identification and determination of benzyl alcohol in a cosmetic product shall be carried out in accordance with that part of Annex E which is headed “Identification and determination of benzyl alcohol in cosmetic products”.
(37) Any test for the identification of zirconium and the determination of zirconium, aluminium and chlorine in non-aerosol anti-perspirants shall be carried out in accordance with that part of Annex E which is headed “Identification of zirconium, and determination of zirconium, aluminium and chlorine in non-aerosol anti-perspirants”.
(38) Any test for the identification and determination of hexamidine, dibromohexamidine, dibromopropamidine and chlorhexidine in a cosmetic product shall be carried out in accordance with that part of Annex E which is headed “Identification and determination of hexamidine, dibromohexamidine, dibromopropamidine and chlorhexidine”.”.
