(1) This Order may be cited as the National Lottery etc. Act 1993 (Commencement No. 2 and Transitional Provisions) Order 1994.
(2) In this Order “the Act” means the National Lottery etc. Act 1993.

The following provisions of the Act shall come into force on 3rd May 1994:
 sections 48 and 49,
 sections 51 to 55,
 section 64 so far as not yet in force,
 Schedules 7 and 8,
 Schedule 10 so far as not yet in force.

The following provisions of the Act shall come into force on 3rd October 1994:
 section 50,
 Schedule 9.

For the purposes of determining whether section 5(3C) or (3D) of the Lotteries and Amusements Act 1976 (“the 1976 Act”) (which was inserted by section 48(3) of the Act) applies to a lottery, any earlier lottery (within the meaning of section 5 of the 1976 Act) shall be disregarded if the date of the lottery fell before 3rd May 1994.

The following provisions of the Lotteries and Amusements Act 1976, namely–
(a) section 11(4A) (which was inserted by section 52(4) of the Act);
(b) section 11(14) (which was inserted by section 52(8) of the Act);
(c) paragraph 11(cc) of Schedule 1 (which was inserted by paragraph 7 of Part I of Schedule 7 to the Act);shall not have effect in relation to any lottery in respect of which any tickets or chances have been sold before 3rd May 1994.

The amendments made to section 11(13) of the Lotteries and Amusements Act 1976 (“the 1976 Act”) by section 52(7) of the Act shall not have effect in relation to any lottery in respect of which any tickets or chances have been sold before 3rd May 1994 but section 11(13) of the 1976 Act shall apply to any such lotteries as if it had not been amended.
