(1) This Order may be cited as the Education (National Curriculum)(Attainment Target and Programmes of Study in Physical Education) Order1992 and shall come into force in accordance with articles 2 to 6.
(2) In this Order—
 “the Document” means the document published by Her Majesty’s Stationery Office entitled “Physical Education in the National Curriculum” ; and
 references to the first, second, third and fourth key stages are references to the periods set out in paragraphs (a) to (d) respectively of section 3(3) of the Education Reform Act 1988.

The provisions of this Order relating to the first key stage shallcome into force—
(a) on 1st August 1992 in respect of pupils in the first year of that key stage; and
(b) on 1st August 1993 in respect of all other pupils.

subject to article 4 the provisions of this Order relating to thesecond key stage shall come into force—
(a) on 1st August 1992 in respect of pupils in the first year of thatkey stage;
(b) on 1st August 1993 in respect of pupils in the second year of thatkey stage;
(c) on 1st August 1994 in respect of pupils in the third year of thatkey stage; and
(d) on 1st August 1995 in respect of all other pupils.

The provisions of this Order, insofar as they apply to the provisions relating to swimming in the programme of study for the second key stage set out in the Document, shall come into force—
(a) on 1st August 1994 in respect of pupils in the first year of thesecond key stage;
(b) on 1st August 1995 in respect of pupils in the second year of thatkey stage;
(c) on 1st August 1996 in respect of pupils in the third year of thatkey stage; and
(d) on 1st August 1997 in respect of all other pupils in that key stage.

The provisions of this Order relating to the third key stage shallcome into force—
(a) on 1st August 1992 in respect of pupils in the first year of thatkey stage;
(b) on 1st August 1993 in respect of pupils in the second year of thatkey stage; and
(c) on 1st August 1994 in respect of all other pupils.

The provisions of this Order relating to the fourth key stage shallcome into force—
(a) on 1st August 1995 in respect of pupils in the first year of thatkey stage; and
(b) on 1st August 1996 in respect of all other pupils.

It is hereby directed that the provisions relating to the attainmenttarget and programmes of study set out in the Document shall have effectas provided in articles 8 to 10 below for the purpose of specifying inrelation to physical education—
(a) an attainment target; and
(b) programmes of study.

The statements described as “end of key stage statements” in the Document are specified as the attainment target for physical education, and each statement applies in relation to the key stage to which it is expressed to relate.

Each programme of study set out in the Document is specified in relation to the key stage to which it is expressed to relate.

The examples printed in italics in the Document (which serve to illustrate the attainment target and programmes of study therein described) do not form part of the provision made by the Order.
