These Regulations may be cited as the Overhead Lines (Exemption) Regulations 1992 and shall come into force on 1st January 1993.

In these Regulations–
 “the 1989 Act” means the Electricity Act 1989;
 “the 1992 Act” means the Transport and Works Act 1992;
 “guided transport”, “tramway”, “trolley vehicle system” and “vehicle” have the same meanings as in section 67 of the 1992 Act.

Section 37(1) of the 1989 Act shall not apply in relation to an electric line which–
(a) has been, or is to be, installed or kept installed in accordance with a power conferred by, or by an order made under, an Act of Parliament; and
(b) has been, or is to be, installed or kept installed for the purposes of a tramway or trolley vehicle system or system using a mode of guided transport prescribed by order made under section 2 of the 1992 Act or authorised by an Act of Parliament passed to confirm an order made under the Private Legislation Procedure (Scotland) Act 1936.
