These Regulations may be cited as the Control of Pollution (Radioactive Waste) (Scotland) Regulations 1991, shall come into force on 2nd December 1991 and shall extend to Scotland only.

In these Regulations–
 “the 1960 Act” means the Radioactive Substances Act 1960;
 “the 1974 Act” means the Control of Pollution Act 1974; and
 “radioactive waste” has the same meaning as in the 1960 Act.

The provisions of the 1974 Act specified in the Schedule to these Regulations shall have effect, without modification, in relation to any radioactive waste as they have effect in relation to effluent or other matter or substance which is not radioactive waste.

Part II of Schedule 1 to the 1960 Act is modified by the substitution for paragraph 9B of the following paragraph:–“

Sections 30A, 30B, 30D, 31(1) to (5) and (7) to (10), 31A, 32, 34 to 42, 46, 53, 55 and 56(1) to (4) of the Control of Pollution Act 1974.”.

The Control of Pollution (Radioactive Waste) Regulations 1984, so far as still in force, and the Control of Pollution (Radioactive Waste) Regulations 1985 are hereby revoked.
