(1) This Order may be cited as the European Commission and Court of Human Rights (Immunities and Privileges) (Amendment) Order 1990.
(2) This Order shall come into force on the date when the Fifth Protocol to the General Agreement on Privileges and Immunities of the Council of Europe enters into force with respect to the United Kingdom. That date shall be notified in the London, Edinburgh and Belfast Gazettes.

The European Commission and Court of Human Rights (Immunities and Privileges) Order 1970 shall be amended as follows:
(a) in Article 2(2) after the definition of “judges of the Court” the following definition shall be inserted—“
 “members of the Commission” means members elected under Article 21 of the Convention;”
(b) after Part III there shall be added—“
PART IV
6 
Members of the Commission and judges of the Court shall enjoy exemption from income tax in respect of emoluments paid to them by the Council of Europe as holders of those offices.”
