(1) These Regulations may be cited as the Cosmetic Products (Safety) (Amendment No.2) Regulations 1988 and, except as provided by paragraphs (2) and (3) below, shall come into force on 1st January 1989.
(2) Regulation 2(b) shall come into force—
(a) in relation to the supply, offering to supply, agreeing to supply, exposing for supply or possessing for supply of cosmetic products by the manufacturer in or importer into the United Kingdom or, in the case of cosmetic products manufactured in or imported into the United Kingdom on behalf of another person, by that other person, on 1st January 1989, except where the cosmetic products are supplied, agreed to be supplied, exposed for supply or possessed for supply by retail in which case they shall come into force on 1st January 1990: and
(b) in all other cases, on 1st January 1990.
(3) Regulation 2(c), (e), (g) and (h) shall come into force—
(a) in relation to the supply, offering to supply, agreeing to supply, exposing for supply or possessing for supply of cosmetic products by the manufacturer in or importer into the United Kingdom or, in the case of cosmetic products manufactured in or imported into the United Kingdom on behalf of another person, by that other person, on 1st January 1990, except where the cosmetic products are supplied, agreed to be supplied, exposed for supply or possessed for supply by retail in which case they shall come into force on 1st January 1992; and;
(b) in all other cases, on 1st January 1992.

The Cosmetic Products (Safety) Regulations 1984 are hereby amended—
(a) in regulation 4(1), in the definition of “the Directive”, by the omission of the word “and” between “Commission Directive No.87/137/EEC” and “Commission Directive No. 87/143/EEC” and by the addition of the words “and Commission Directive No. 88/233/EEC (q)” and by the insertion as a footnote at the foot of the relevant page of the following—“
(q) O.J. L105, 26.4.88, p. 11”;
(b) in Schedule 1 by—
(i) the deletion in entry Numbers 212, 213 and 397 of “(except as those impurities of tribromosalicylanide permitted in accordance with the requirements specified in column 5 of Part II of Schedule 2)”; and
(ii) the insertion after entry Number 681 of the following—

(a) Hair waving or straightening products:   The directions for use drawn up in the national or official language(s) must obligatorily incorporate the following sentences:
— Avoid contact with eyes
— In the event of contact with eyes, rinse immediately with plenty of water and seek medical advice
— Wear suitable gloves ((a) and (c) only) 
(a) :
— Contains thioglycolate
— Follow the instructions
— Keep out of reach of children
— For professional use only (where applicable)

— May cause sensitization in the event of skin contact
— Avoid contact with eyes
— In the event of contact with eyes, rinse immediately with plenty of water and seek medical advice
— Wear suitable gloves 
— Contains thioglycolate
— Follow the instructions
— Keep out of reach of children
— For professional use only (where applicable)

— general use 
— 8 per cent ready for use pH 6 to 9.5

— professional use 
— 11 per cent ready for use pH 6 to 9.5
 The above-mentioned percentages are calculated as thioglycollic acid 
52 Quinolin-8-ol and bis (8-hydroxy-quinolium) sulphate Stabilizer for hydrogen peroxide in rinse-off hair-care preparations 0.3 per cent calculated as base   
Stabilizer for hydrogen peroxide in non-rinse-off hair-care prepara-tions 0.03 per cent calculated as base”   
(ii) the insertion after entry Number 53 of the following—

(e) in Part I of Schedule 3 by—
(i) the insertion at the end, in Column 1 of “Acid Red 195”, in Column 2 of “red” and in Column 3, sub-column 3, of “X”; and
(ii) the omission of the entries relating to colour index number 13065;
(f) in Part II of Schedule 3 by—
(i) the substitution in Column 5 relating to colour index numbers 13065, 21110, 42535, 44045, 61554 and 73900 of “31.12.1988” for “31.12.1987”;
(ii) the omission of the entries relating to name or colour index numbers 12700, 44025, 73312 and Acid red 195; and
(iii) the omission of the entry in Column 4 relating to colour index number 13065;
(g) in Part I of Schedule 5 by—
(i) the omission of the entry in Column 5 relating to entry number 19; and
(ii) the insertion
after entry Number 40 of the following—
