These Regulations, which may be cited as the Social Security (Credits) Amendment (No. 2) Regulations 1987, amend the Social Security (Credits) Regulations 1975 and shall come into force on 10th May 1987.

In regulation 9 of the Social Security (Credits) Regulations 1975 (credits for unemployment or incapacity for work) —
(a) in paragraph (5)(d) for the words “that Act.” there shall be substituted the words “that Act; or”;
(b) after paragraph (5)(d) there shall be added the following sub-paragraph —“
(e) by virtue of regulation 3 of the Social Security (Unemployment, Sickness and Invalidity Benefit) Regulations 1983 would be deemed to be a day on which he was incapable of work, but for the fact that in the week of incapacity of which the day forms part, he was a member of a local authority who was a councillor and was entitled to an attendance allowance payable under section 173(1) of the Local Government Act 1972 or under section 45(1) of the Local Government (Scotland) Act 1973( which exceeded the maximum weekly earnings prescribed in the said regulation 3(3).”.
(c) in paragraph (9)(f) after the words “incapacity for work;” there shall be added the word “or”;
(d) after paragraph (9)(f) there shall be added the following sub-paragraph —“
(g) for the relevant past year that person is entitled to be credited with earnings in respect of any one week which included one or more days of incapacity for work specified in paragraph (5)(e);”.
