(1) This order may be cited as the Smoke Control Areas (Exempted Fireplaces) Order 1984 and shall come into operation on 24th November 1984.
(2) This order shall extend to England and Wales.

(1) Fireplaces of the classes described in the Schedule hereto shall, upon the conditions specified in paragraph (2) below, be exempted from the provisions of section 11 of the Clean Air Act 1956 (which empowers a local authority to declare the whole or any part of their district to be a smoke control area).
(2) The conditions mentioned in paragraph (1) are that the fireplace shall be installed, maintained and operated so as to minimise the emission of smoke at all times, and in accordance with the relevant manufacturer's instructions which bear the appropriate reference specified in the said Schedule.

The Smoke Control Areas (Exempted Fireplaces) (No. 4) Order 1983 is hereby revoked.
